Terms of Service

Welcome to Swypi, a service operated by Swypi LLC. By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Agreement to terms
By using Swypi, you agree to these Terms and our Privacy Policy. If you don't agree to these Terms, you may not use the service.
2. Eligibility
- You must be at least 13 years old to use Swypi.
- If you are under 18, you must have parental consent.
- You may only create and maintain one account.
- You are responsible for maintaining the security of your account.
3. Your account
You are responsible for:
- Providing accurate and complete registration information.
- Maintaining the confidentiality of your password.
- All activities that occur under your account.
- Notifying us immediately of any unauthorized use.
4. Your content
When you post content on Swypi:
- You retain ownership of your content.
- You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your content for the purpose of operating and promoting the service.
- You represent and warrant that you own or have obtained all rights, licenses, and permissions necessary to post your content.
- Music and audio: if your content includes any music, sound recording, or other audio, you represent and warrant that you hold all necessary rights to both the sound recording (master) and the underlying musical composition, or that the audio is otherwise cleared for your use. Do not post content containing copyrighted music you are not authorized to use, and do not play copyrighted music during livestreams.
- You are solely responsible for your content and the consequences of posting it.
4A. Post visibility
Every post you create has a visibility level: Public, Followers, or Private. We enforce visibility server-side — the server will not return Followers-only or Private posts to viewers who are not entitled to see them. However:
- We cannot prevent a viewer who can see your post from screen-recording or screenshotting it. Choose your audience accordingly.
- Changing a post to a more restrictive visibility does not recall copies that already exist.
- "Followers" visibility applies at the time of fetch; users who unfollow you lose access to subsequently-fetched copies.
4B. Sensitive content
If your content is appropriate for adults but not all audiences, you must mark it as Sensitive Content in the composer and choose the most accurate category (Nudity, Violence, Disturbing, or Other). Mis-marking — either failing to mark sensitive content or marking non-sensitive content as sensitive to game the algorithm — is itself a violation. The marker is not a license to post content otherwise prohibited by these Terms or the Community Guidelines.
4C. Sealed Posts
You may create a Sealed Post that hides its media behind an unlock target — either an engagement count (likes, saves, or comments) or a time threshold.
- The unlock target is your decision, not a guarantee by Swypi that the post will reach it. A sealed post that never hits its target remains locked.
- You may not use sealed posts to extract engagement under deceptive premises (for example, implying a nudity reveal and unlocking unrelated content).
- Users who engaged with your sealed post may be credited as contributors in the unlock surface.
- Once unlocked, a sealed post is treated as a normal post for visibility and licensing purposes.
5. Prohibited conduct
You agree not to:
- Violate our Community Guidelines.
- Post illegal, harmful, or offensive content.
- Harass, bully, or threaten other users.
- Impersonate others or provide false information.
- Post content that infringes anyone's intellectual property or other rights.
- Use the service for unauthorized commercial purposes.
- Attempt to gain unauthorized access to our systems.
- Use bots, scrapers, or automated tools.
- Circumvent any security measures.
- Engage in monetization fraud (self-gifting through alternate accounts, coordinated-gifting rings to extract payouts, misrepresenting your identity during Stripe Connect onboarding, using stolen payment methods to buy coins, soliciting gifts off-platform for on-platform conduct, baiting engagement on sealed posts under false premises, or selling an account that holds a coin or diamond balance).
- Broadcast prohibited content live, or use live streams to evade post-moderation.
- Hijack a Watch Together party to share content the host did not authorize.
6. Objectionable content, safety, and enforcement
There is zero tolerance for objectionable content or abusive behavior on Swypi. By using the service you agree not to post content or engage in conduct that is harassing, threatening, hateful, sexually explicit, or otherwise objectionable. To keep the community safe, we:
- Let you report objectionable content and abusive users directly in the app;
- Review reports and act on objectionable content within 24 hours, including removing the content and ejecting the user who provided it where appropriate;
- Let you block any user so you no longer see their content or receive messages from them; and
- Filter and moderate content that violates these Terms or our Community Guidelines.
7. Virtual currency and in-app purchases
Swypi offers virtual items, including "coins" and "diamonds" (collectively, "Virtual Currency"), which can be purchased through Apple's in-app purchase system and used within the app (for example, to send gifts during livestreams).
- Virtual Currency is a limited, personal, non-transferable, revocable license to a feature of the service. It has no monetary value, is not your property, and cannot be redeemed for real-world currency except through the creator-payout program described in Section 7A, subject to its own terms and eligibility.
- All purchases of Virtual Currency are final and non-refundable, except where a refund is required by law or by Apple's policies. Refund requests for App Store purchases are handled by Apple.
- Prices are shown in the app and may change. We may modify, manage, or discontinue Virtual Currency at any time.
- Any unused Virtual Currency is forfeited if your account is terminated for violating these Terms or is closed at your request.
- Gift sends are final once confirmed; you cannot recall a gift.
- Chargeback / refund clawback: if a coin purchase is reversed by Apple, your coin balance will be debited accordingly. If you have already sent gifts funded by reversed coins, we may claw back the recipient's diamonds and any cash earnings attributable to those gifts.
- The coin / diamond / gift system is not gambling. Gifts are voluntary and do not entitle the sender to any reward beyond acknowledgement.
7A. Creator monetization and withdrawals
Creators may convert diamonds earned from gifts into cash through our payment partner Stripe Connect.
- You must be at least the age of majority in your jurisdiction (18+ in most U.S. states) to enable withdrawals.
- You must complete identity verification and provide tax and payout information directly to Stripe. Swypi does not see or store your bank account number — we receive only an opaque account identifier and your onboarding status.
- Conversion rates from diamonds to cash, Swypi's platform fee, and any third-party fees are disclosed in Settings → Earnings. The rate at the time you initiate a withdrawal is the rate that applies to that withdrawal.
- Withdrawals are subject to a minimum threshold disclosed in-app and may be delayed for fraud review, identity re-verification, or compliance with applicable law.
- Stripe's own Connected Account Agreement and Privacy Policy apply to your use of Stripe Connect through Swypi.
- Tax forms (for example, U.S. IRS Form 1099-K) will be issued by Stripe or Swypi as required by law for creators above the applicable threshold.
7B. Shop (powered by Shopify)
The in-app Shop offers physical products (currently a curated gold-jewelry catalog) through a Shopify Storefront integration.
- Shopify is the merchant of record for shop purchases. Card payments are processed by Shopify and its payment processors; Swypi does not handle or store card numbers.
- Pricing, taxes, shipping fees, and delivery timelines are set and displayed by the Shopify storefront at checkout.
- Returns, refunds, and shipping disputes are handled per the storefront's return policy. Contact information for shop support appears on checkout pages and order receipts.
- Swypi is not responsible for the physical fulfillment of shop orders or for disputes about product condition or shipping; our role is limited to surfacing the storefront inside the app.
7C. Live streaming and Watch Together
When you broadcast live, you are publishing in real time. You are responsible for everything that appears on the stream, including comments, gifts, co-host contributions, and audio picked up by the stream.
- Live streams may be moderated, suspended, or terminated by Swypi at any time, including during the broadcast.
- Co-hosts must independently accept your invite; by inviting a co-host you are not vouching for their compliance with these Terms, but you are responsible for the audience you bring to a co-host's broadcast.
- A Watch Together party host controls playback for all viewers. The host must have the right to share the party content for synchronous group viewing.
8. Intellectual property
The service and its original content (excluding user content) are owned by Swypi and protected by copyright, trademark, and other laws. Our trademarks may not be used without prior written permission.
9. DMCA and copyright
We respect intellectual property rights. If you believe your copyright has been infringed, see our Copyright & DMCA Policy or send a notice to copyright@swypi.app. We will respond to valid notices expeditiously and terminate repeat infringers.
10. Indemnification
You agree to indemnify, defend, and hold harmless Swypi LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your content, including any claim that it infringes intellectual property or other rights (including any music or audio it contains); (b) your use of the service; or (c) your violation of these Terms or any law or the rights of a third party.
11. Termination
We may suspend or terminate your account at any time for any reason, including violation of these Terms. You may delete your account at any time through the app settings.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWYPI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
14. Changes to terms
We may modify these Terms at any time. We will notify you of material changes by posting a notice on the service. Continued use after changes constitutes acceptance.
15. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law principles.
