Copyright & DMCA Policy

1. DMCA compliance statement
Swypi respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), Swypi will respond promptly to claims of copyright infringement committed using the Swypi service that are reported to our designated copyright agent.
If you are a copyright owner, or authorized to act on behalf of one, and you believe that copyrighted work has been copied in a way that constitutes copyright infringement occurring on the Swypi platform, please submit a notification pursuant to the DMCA by providing our designated agent with the information described below.
2. How to submit a takedown request
To file a DMCA takedown notice, you may either:
- Send an email to copyright@swypi.app, or
- Submit a takedown request through our API at
POST https://api.swypi.app/api/v1/copyright/takedown.
Your notification must include the following:
- Your full legal name (and company name, if applicable).
- Your email address for follow-up correspondence.
- A description of the copyrighted work that you claim has been infringed.
- The URL or post ID of the allegedly infringing content on Swypi.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.
- Your physical or electronic signature (typing your full name is accepted as an electronic signature).
Important: under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorney fees.
3. Counter-notification process
If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification. To submit a counter-notice, you must be a registered Swypi user and provide the following:
- Identification of the content that was removed, and the location where it appeared before removal (the takedown request ID).
- A statement under penalty of perjury that you have a good faith belief that the content was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district, and that you will accept service of process from the person who provided the original takedown notification.
- Your physical or electronic signature.
Counter-notifications can be submitted by authenticated Swypi users through our API at POST https://api.swypi.app/api/v1/copyright/counter-notice.
Upon receipt of a valid counter-notification, Swypi will forward it to the original complaining party. If the original complaining party does not file a court action within 10 business days, Swypi may restore the removed content.
4. Repeat infringer policy
In accordance with the DMCA and other applicable law, Swypi has adopted a policy of terminating, in appropriate circumstances and at Swypi's sole discretion, users who are deemed to be repeat infringers.
Three-strike policy: Swypi maintains a copyright strike system. Each valid DMCA takedown that results in content removal adds one strike to the user's account.
Upon receiving three (3) copyright strikes, the user's account will be permanently suspended. Users may view their current strike count within the app or via the API.
Swypi may also terminate the accounts of users who are found to be repeat infringers even if they have not yet accumulated three strikes, at our sole discretion.
5. Scope: where Swypi can act
We can act on DMCA notices for content hosted by Swypi:
- Posts (videos, images, multi-media carousels), including locked Sealed Posts.
- Stories (active and archived), with reactions, replies, polls, stickers, and music selections.
- Live stream recordings (where available).
- Watch Together party media that Swypi hosts (the host's source media).
- Direct-message media that another user has reported to us.
- Profile media (avatars, banners) and comments.
We cannot directly act on:
- Live audio or video that is actively broadcasting — we will moderate it forward, but a historical broadcast may not be retained.
- Content in the Shop. Physical products and product listings are managed by Shopify. IP complaints about shop listings should be sent to Shopify under their own IP policy.
